The American Arbitration Association (AAA-ICDR) has launched an “AI Arbitrator” for construction cases decided on documents only, with every outcome validated by a human arbitrator.
It is a useful example because it shows the direction clearly: artificial intelligence used close to the decision, in a narrow kind of case, with a person who stays responsible. It is also a good subject for discussion at conferences and in arbitration practice.
It also shows why independent assessment matters. The AI Act classifies as high-risk the artificial intelligence systems used to assist judicial authorities, or used in a similar way in alternative dispute resolution. Arbitration that relies on such tools is exactly where an independent check of how they work makes sense.
